GENERAL TERMS AND CONDITIONS OF USE
1. WHAT DOES THE PLATFORM OFFER?
1.1. The platform offers the possibility for you to receive a personalized art gallery with works of art, according to your ancestry. 1.2. This art gallery is based on the ancestry information that the user will fill in on the main page, and Genera or its agency VML Brasil Propaganda Ltda. is not involved in the information imputed on the platform, or in the result. 1.3. The selected works of art have only the information filled in as a filter, and through Artificial Intelligence, with information filled in, the galleries are created, and it is not possible for the user, Genera, or any other Supplier, to choose which works of art will be selected for each gallery. 2. WHAT DOES THE USER NEED TO KNOW ABOUT THE PLATFORM?
2.1. The platform was developed to create a personalized gallery of artworks, based on ancestry information, filled out by each user on the platform, regardless of whether or not they have taken Genera's genetic test. The platform does not perform any inspection or access control over the information that will be filled in by each user. 3. HOW TO GET THE GALLERY?
3.1. The user will receive the personalized gallery of works of art, through the email informed when filling in the registration information. 4. PROTECTION OF PERSONAL DATA
4.1. Your data will not be stored by Genera, agency, or any supplier. 4.2. After filling in the basic information for the preparation of the art gallery, the data collected is automatically discarded. 4.5. The user is responsible for the device used to access the platform, as well as the cybersecurity of such device, and must use the necessary measures to protect them against loss, destruction, alterations, disclosures and unauthorized access, whether accidental or not ("Incident"). 5. WHAT ARE THE USER'S RESPONSIBILITIES WHEN ACCESSING THE PLATFORM?
5.1. Through these Terms, you declare that you are aware that you are solely and exclusively responsible for the access and use you make of the platform. 5.1.1. The user is aware that he is solely and exclusively responsible for the use and comments made through his Profile on the platform, and any offensive content and/or that infringes the rights of other users is prohibited. 5.2. The user declares and acknowledges that he is solely responsible for all access and activities associated with his order. 5.3. The user declares that the personal information provided is faithful and true and undertakes to keep it always up to date, acting in good faith and in the enjoyment of its civil capacity to enter into this Agreement, declaring that it has understood, read and agrees with all the Terms and Conditions set forth herein. 6. WHAT ARE THE RESPONSIBILITIES OF THE USER AND GENERA?
6.1. The user agrees to use the platform appropriately, only for lawful purposes and in accordance with the rules set forth in these Terms. You represent and warrant that you will fully comply with the rules of these Terms as well as applicable law. 6.2. The user declares and acknowledges that: (i) Genera does not offer any guarantee, explicit or implicit, related to the platform, whether referring to quality, performance, functioning, performance, fitness for a specific purpose, regulatory or technical, as well as in relation to any result derived from its use by the user; (ii) it is prohibited to copy, sell, share, publish or use the Platform and the Custom Art Gallery and its works, for commercial purposes or for any purpose other than those permitted by these Terms, as well as to use and access the Platform or to perform acts that impair its security, integrity, availability and/or its normal functioning and access to the Platform, or any data contained therein, in an unauthorized manner; (iii) Genera and its Suppliers are not responsible for the works of art that are selected through Artificial Intelligence. 6.3. Genera does not offer users technical support, maintenance, Internet access or any other technical services necessary for the use of the platform. Thus, Genera is not responsible for failures in the platform arising from circumstances beyond its control and control, whether or not caused by services provided by third parties on which the operation of the platform depends, such as fortuitous events or force majeure, hacker interventions and malicious software, technical failures of any kind, including, failures in accessing or browsing the platform resulting from failures on the Internet in general, power outages, electronic and/or physical malfunction of any network, interruptions or suspensions of connection and failures of the user's software and/or hardware, scheduled outages for maintenance, updating and configuration adjustments of the platform, any human error of any other kind, which may occur during the processing of the information. The user exempts Genera from any liability arising from such facts, acts and/or situations. 6.4. Genera, partners, employees or agents will not, under any circumstances, be held liable for direct or indirect damages that result from, or that are related to, the user's access to and use of the platform. 6.5. The user understands and agrees that Genera may, at its sole discretion and without any justification, interrupt and/or discontinue the user's access to the platform and/or part of its functionalities, without any compensation being due to the user. 6.6. It is the responsibility of the user: (i) keep the environment of their devices accessing the platform secure, using specific tools for this purpose, such as antivirus, firewall, among others, in order to contribute to the prevention of electronic risks; (ii) use updated and efficient browsers and operating systems for the full use of the platform; (iii) equip and be responsible for the hardware devices necessary for access to the platform, as well as for their access to the Internet, and (iv) not disseminate or install viruses or any other malicious code, file or software on the platform for the purpose of corrupting information and data, interrupting, destroying, improperly accessing, limiting or interfering with the operation or security of the platform and third-party equipment, such as other users. 6.7. The user is responsible for any and all violations of these terms and may be liable to Genera for all losses, damages and damages, direct and/or indirect, that it causes, and that arise from claims by third parties (judicial, extrajudicial and administrative), as well as civil and criminal sanctions provided for in the applicable legislation, committing to indemnify Genera from all costs, expenses and attorneys' fees (judicial and administrative) arising from such losses. 7. WHAT ELSE DO I NEED TO KNOW ABOUT THESE TERMS OF USE?
7.5. These Terms are governed by the laws of the Federative Republic of Brazil. Any doubts and situations not provided for in these Terms will be first resolved by Genera and, if they persist, they must be resolved by the court of the District of the Capital of São Paulo, to the exclusion of any other, however privileged it may be or may be. 7.6.
